United States District Court Grants Preliminary Injunction Order Against Amica Software, Inc. Also Known As Nuvisoft Software, Inc.

Philadelphia, Pa., January 29, 2003 ­ On December 23, 2002, the Honorable Judge Petrese Tucker issued a Preliminary Injunction in the United States District Court for the Eastern District of Pennsylvania on behalf of Scanvec Amiable against defendants Jim Chang, Yuan Chang, also known as Charlie Chang, Randy Nepomuceno, Luciana Chang, Amica Software, Inc. also known as Amiable Software, Inc. and Nuvisoft Software, Inc., Amica China, Inc. and Amica China Co., Ltd.

The Preliminary Injunction expanded on the injunction entered on September 30, 2002, which prohibited defendants from using the marks Amica, Amiable or PhotoPRINT™. The new injunction prohibits defendants globally from participating in the development, distribution or sale of any computer software product that compete with PhotoPRINT™ or any of its derivative products. The Injunction further prohibits defendants from using or disclosing any of Scanvec Amiable’s trade secrets or confidential information and from soliciting any of Scanvec Amiable’s customers or employees.

On January 27, 2002, the United States Court of Appeals for the Third Circuit denied defendants’ Motion for a Stay pending appeal.
